I have just returned from a trip to Springfield, Missouri, where I visited with Ramsey. He is continuing to regain his strength, and has begun recalling eleven years of pain and suffering in Leavenworth, due to a lack of medical attention.
Enclosed is a letter recently sent to the warden at the United States Medical Center for Federal Prisoners. Know that a report from Dr. Pete Garcia was attached to the letter.

I write this letter on behalf of my husband and myself, and our families. As you are aware, my husband, Ramiro R. Muniz, was recently sent to the United States Medical Center in Springfield, Missouri as a result of a serious life threatening illness. Prior to his transfer to Springfield, he was at the United States Penitentiary in Leavenworth, Kansas, a maximum-security prison.
Enclosed is a letter and medical report written in 1995 by Dr. Pete Garcia, Orthopedic Surgeon in Corpus Christi, Texas. This report was sent to the Warden at the United States Penitentiary in Leavenworth to describe my husband's poor health. Mr. Muniz suffers from a herniated disc and knee injuries. Dr. Garcia indicated that he was in need of surgery to avoid the pain from this condition. Although the letter and report were sent in 1995, records will show that Mr. Muniz was denied medical treatment for those injuries. He went through great pain and suffering for eleven years.
While at the United States Penitentiary in Leavenworth in 1996, Mr. Muniz suffered a serious fall and hurt his hip. The pain endured was excruciating, and in his injured condition he had to walk in the snow to make an appointment with medical staff and again to receive a medical examination. Leavenworth records will reflect that Mr. Muniz was never sent to the U.S. Medical Center in Springfield, Missouri. Instead, he was given aspirin and Motrin. He endured great pain and suffering for a serious hip injury, and now requires a cane for walking.
Today Mr. Muniz is housed in the United States Medical Center in Springfield, Missouri as a result of complications from a life threatening surgery performed in August of 2005. While at Springfield he has begun recalling the trauma experienced from being denied medical treatment at Leavenworth for extremely painful injuries.
I am trying to understand why my husband had to endure great suffering for eleven years. He suffers from a herniated disc, injured knees, a deteriorated hip, and he is 63 years old. He went through great pain and suffering even though records will show that he is a peaceful man. He had no incident reports throughout the eleven years that he was at Leavenworth.
We are aware that my husband's hip has deteriorated and requires replacement if he is to walk without the assistance of a cane. We ask that you allow him time before undergoing hip replacement surgery. This time will allow him to recuperate from the mental and emotional trauma experienced through the recent life threatening surgery, and help him gain strength that he has lost from being on a liquid diet for over six months.
Perhaps surgery for his knees can precede his hip surgery. If this is possible, then please consider this option. Understand that hip surgery is not being avoided. We merely ask for time in which to recuperate from the trauma of his last surgery.
Many congressmen support our efforts to seek humanitarian support for a man who has suffered greatly, in spite of the fact that he has been a model prisoner for the past eleven years. The staff at Leavenworth was well aware of his good conduct, yet did nothing to help him lower his security level.
My husband is in no condition to be placed in a penitentiary. This move would pose a threat to his life considering his poor health, which has worsened from being denied medical treatment. If Mr. Muniz does not receive assistance from the Bureau of Prisons, we want to know why. Our families, friends, congressmen and supporters await your response.

Joe A Ortiz (National Civil Rights Director, American GI Forum) Writes Letter to the Caller Times (and it got published)
Should step down
We know that Del Mar College President Carlos Garcia is responsible to the Board of Regents. However, President Garcia should be more responsible to the public. His actions are compromising education at Del Mar.
Del Mar President Garcia should relinquish his position until the present investigation is completed.
The board is doing a disservice to the public by keeping Del Mar President Garcia as president while there is a cloud of suspicion and his integrity is being questioned and investigated.

Dear GI Forum Members, Did Juan Garcia Not "Cut & Run" One Time Already? WATT Did Juan Do For The GI Forum & Archives? Bail Out? Quit?
Around October 18, 2005 when Juan Garcia was “recently appointed to the board of the National Archives and Historical Foundation of the American GI Forum” he made commitments to the Public as well as the American GI Forum (AGIF) and the Hector P Garcia Familia (according to the CCCT Article Written By Neil Falgoust):
“If this initial review raises the possibility of any suspicious activity, at least one newly appointed board member said he would push for a more thorough audit.”
"There are real substantive questions about the financial history of the organization," said Juan Garcia III, who was recently appointed to the board of the National Archives and Historical Foundation of the American GI Forum. The accountant hired by the foundation, Adelfino Palacios, is Hector Garcia's former personal accountant and has previously handled the foundation's finances.
Juan Garcia III said “he hopes the financial review will rebuild trust in the beleaguered foundation”. He said, “the results of the review would be made public”.
"It's difficult to ask people to support us with resources if they don't have the confidence," he said.
Did Juan Garcia keep his commitments?

The next thing Juan Garcia does is Bail Out, he quit, give up or WATT ever synonym Juan uses; he didn’t have the wherewithal or the balls to stick it out and fight to rebuild the beleaguered foundation?
Did suddenly, he discover he was going to have to work for it? IMO, Juan was appointed to the National Archives and Historical Foundation of the American GI Forum in the hopes to generate Political Status? Is that is why he was there? Why does he not tout this endeavor as community service / ties to the community? Did he intend to use the AMERICAN GI FORUM as a stepping-stone? Now, does he intend to use the HD #32 State Representative Position as a stepping-stone to Washington DC or is that just “talk about the future”?

GI Forum Archives won't open their books for audit
Local attorney Juan Garcia III resigned as a board member of the nonprofit National Archives and Historical Foundation of the American GI Forum on Thursday, citing a lack of oversight for the organization's finances.
Garcia made his decision after board Chairman Amador Garcia refused an audit of the foundation's finances.
Is that WATT Juan Garcia will do when the Lege refuses to answer “Real Substantive Questions”?
Quit?
Is that WATT Juan Garcia did when Gene Seaman refused to answer “Real Substantive Questions”?
Give up?
Now after fulfilling none of these commitments,
Is it difficult for Juan Garcia “to ask people to support him with resources”?
There are no excuses for Juan Garcia except one,
YOU CAN’T TRUST HIM.

"The Johnny Canales Show" was for Tejano Music Like Ed Sullivan was for Pop Music. Let us not forget who gave YOU the Chance Tejano Musica.

Johnny Canales is a former Tejano musician, and was host of the popular show titled "The Johnny Canales Show" which showcased up-and-coming bands from Mexico and the United States, including La Mafia, Selena, Mazz, Intocable, and Jennifer Pena. It aired on Televisa in Mexico and Univision in the United States from the mid-1980s until 1996. In 1997 he made the transition to The Telemundo Networks. The show only lasted 3 seasons on Telemundo. In 2002 Johnny Canales reached an agreement to bring the show back to its original home The Televisa Networks, and to start touring again doing shows in the Southwest part of The United States and Mexico. In 2005 the show was taken off the air, leading to an outcry by the Hispanic community for the loss of the show.

Dear Commander Morales:
This letter is to revisit the resolutions ratified at the American GI Forum of the United States National Conference (2006). Specifically, the Johnny Canales Resolution:
#10. Resolution to direct that the American GI Forum of the United States enter into a dialog with NBC Universal and Telemundo representatives on behalf of the Hispanic community to ensure that more diversity is provided at all levels of the entertainment field, which includes programming reflective of the entire community, including the retention of long-time Hispanic entertainment personalities and other employees facing layoffs as a result of the acquisition of Telemundo television by NBC Universal. Of particular concern is the pending actions against long-time Hispanic personality, Tejano music icon, and veteran, Mr. Johnny Canales, and other mostly Hispanic Telemundo television employees.
Resolution #10 passed and the Resolutions Committee recommended adoption. There was much discussion including recommendations to petition sister civil rights and other Hispanic organizations into joining the AGIF in support of this petition and if necessary; directing the boycotting of Telemundo and NBC Universal Television and the products they endorse. The Resolution was brought to a vote and the membership approved the resolution and directed the executive board to take action to make the intent of this important resolution known to the appropriate offices or individuals. (This resolution was submitted by National Civil Rights Director Joe A. Ortiz of Texas). (Secretary’s recommendations – For National Commander to direct Civil Rights director to determine what local NBC/Telemundo affiliate community relations area officer can be contacted to establish issues dialog.
With this being reiterated, and as Telemundo has remained indifferent to our concerns, we must follow through on our commitments written in the above resolution. There should be no compromise. Financial considerations have no place usurping our steadfastness as a unified civil rights organization. So the question is, will we honor our commitment and follow through or will we allow our written resolutions to be ignored and our influence as the Veteran's Civil Rights Champion to endure such disrespect. Will we stand idle or will we mobilize? Remember Coors, we won that battle and we will win this one as well. Additionally we have the support of the Hispanic Congressional Caucus.

South Texas people are not going to tolerate the wrong committed against Mr. Canales

Dear Commander Morales,
Subject: Telemundo / NBC / GE Negotiations
At our 2006 AGIF-US National Conference held in Overland Park, Kansas, we unanimously ratified a resolution (Johnny Canales Resolution) outlining specific wrongs, hurtful and discriminatory transgressions (committed by NBC / Telemundo / GE) to Mr. Canales and the loss (of the Johnny Canales Show) to the South Texas Community. The resolution requested the AGIF-US support Johnny Canales and his case with Telemundo / NBC / GE. The resolution stated, should Telemundo / NBC / GE not agree to the terms we presented to them in Miami, Florida; numerous boycotts throughout the United States were to be conducted. The proposed boycotts were with the intent to send an influential message to the media giant Telemundo / NBC / General Electric. South Texas people are not going to tolerate the wrong committed against Mr. Canales. It is a wrong committed against a whole South Texas. The Johnny Canales Resolution passed unanimously. Now that Telemundo / NBC / General Electric have chosen not to agree to the terms we presented to them in Miami, Florida; we must proceed with what the resolution called for should no agreement be honored (should Telemundo / NBC / GE not agree to the terms).
We must now conduct our Nation wide boycott.
The AGIF-US has always been a big advocate defending the rights of individuals whom have been discriminated against. The AGIF-US has always been the voice speaking out for those individuals unable to speak for themselves. Now today, the AGIF-US must continue to demand Mr. Canales’ and South Texas’ rights are protected.
From the genesis, the AGIF National Civil Rights Director and lead representative in advocacy of Mr. Canales and the South Texas Community; has been in communication with Telemundo / NBC networks. Both network entities have informed us of unsanctioned communications (circumventing contact) regarding Mr. Johnny Canales / “Johnny Canales Show” negotiations. For several years, as the National Civil Rights Director of the American GI Forum (AGIF-US) Joe A Ortiz has worked under multiple National Commanders, this is the first time a National Commander inserts (forces) himself into negotiations of a case being overseen by the AGIF-US National Civil Rights Director. Not only is this action undermining and usurping. With all due respect to Commander Morales, one must question and challenge his involvement / capacity in the aforementioned unsanctioned negotiations (circumventing contact). Mr. Victor Cabral said, "he would not communicate with Mr. Ortiz because the negotiations were being handled between Mr. Tony Morales and himself.
What has the intervention / involvement (of Commander Tony Morales) produced?
Is the outcome within the resolve of the Johnny Canales Resolution?
Was the “Johnny Canales Resolution” adhered to?
With regard to Mr. Canales’ livelihood, that of his family and the loss (of the Johnny Canales Show) to the South Texas Community; is this the brand of JUSTICE the American GI Forum (under Commander Tony Morales) demands?
For future reference and to prevent division within our ranks, please direct all circumventing contact back to the original AGIF spokesperson. This practice is not only proper it is honorable.
In the decorum and spirit of the National Conference and the resolutions, to wit, it is mandated the Johnny Canales Resolution be adhered to. As the AGIF National Civil Rights Director, it is Joe A Ortiz' duty to uphold the dignity, respect and unanimous ratification of the American GI Forum resolutions and in so doing preserve the honor and integrity (our WORD) of our hierarchical structure.

Subject: 1st LULAC/CPP Hispanic American Veteran's Affair's Summit
Concerns of an ongoing Coup De Maitre have been brought to our attention regarding the AMERICAN G I FORUM (AGIF) Partnership with LULAC and the conflicting interest involving Veteran’s Affairs. The first issue stems from the LULAC platform regarding the exclusion of Americans. The American GI Forum represents American Soldiers, their Widows and their children. There is no stipulation that they be Latin American, only that they are American. The next issue addresses LULAC and the involvement in Veteran’s Affairs. We are not opposed to the involvement in goodwill but the redirection of finances for the benefit of LULAC and the exclusion of the AMERICAN G I FORUM (AGIF) Jurisdiction with respect to Veteran’s Affairs. LULAC endeavors not to represent American Soldiers as a whole but only the Latin American Soldiers. The AMERICAN G I FORUM (AGIF) cannot allow the progress it has made involving Veterans’ Affairs and it’s important role as THE American Soldier’s Advocate to be usurped / relinquished. Furthermore, participation in this event compromises the principles on which the AMERICAN G I FORUM (AGIF) is founded. Should this Partnership continue as it is, the AMERICAN G I FORUM’s funding (Grant Monies, Military Training, Workshops etc..) will be compromised and reduced significantly? Did the AMERICAN G I FORUM (AGIF) authorize this partnership? If so, please explain how this decision circumvented the members and who authorized the partnership?

In reality, this is the first time I have shared with the entire world the pain, suffering, and sacrifice I have endured for the last 13 years. There is no question in my heart that once I'm transferred to an FCI in Texas I will immediately re/open my case and prove once and for all the gross blatant injustices committed against me and my family. Yes, I'm a Mexican political prisoner and if I'm not then why have they kept me in exile and solitary confinement for 13 years- why?
Please feel free to follow/ up on those who I submitted a copy of my letter to.
Especially the politicians involved…
Again, I thank you for your most profound consideration and assistance. I pray that soon we will visit in Texas…

As you well know, I'm trying to return to Texas after 13 years in exile. After my near/death illness and confined in the hole in Springfield Medical Federal Facility, I was of the opinion that because of my health I would be transferred to an FCI facility in Texas.
Instead, I was chained and shackled in the middle of the night and in the dawn of the morning. I find myself in one of America's highest security penitentiary. Constantly, we are in lock/down status, which means I'm confined in my 6x9 cell twenty-four hours a day.
Anyone who desires will find, as a matter of law I'm entitled to be incarcerated in a Federal Correctional Institution (FCI) and not in a penitentiary. My institutional record clearly reflects I have never received an institutional disciplinary incident report in 13 years. Which in the language of Bureau of Prisons, it would make me a model prisoner….
Further, my trial sentencing transcript reflects that it was the "legal intentions" of federal Judge Brown in Sherman, Texas, that I be confined at Three Rivers Federal Correctional Institution in Three Rivers, Texas. Instead, I was chained and shackled the next day and for the last 12 years, I was incarcerated at Leavenworth Federal Penitentiary. It has been extremely difficult to live with the fact and truth that my CONSTITUTIONAL RIGHTS under the United States Constitution of America have been purposely and maliciously violated by the Bureau of Prisons.
The violation of my Fifth Amendment, Due Process of the law (the bureau of Prisons and the United States Marshall's Office decided to disregard the legal Judicial intentions of Federal Judge Brown),
The violation of my Eighth Amendment, Cruel and unusual punishment (my incarceration in America's hardest/core penitentiaries for the last 12 years has been cruel and unusual punishment since I have never been a violent individual and/or committed any physical acts of violence),
The violation of my Fourteenth Amendment, Equal Protection of the law,( the law judicially delegated and declared in open court that I be confined in a federal correctional institution(FCI). Instead, I continue to find myself confined to one of the highest security penitentiary's in America.
Domingo, with the facts enclosed, as they exist this very day, please be so kind as to share the same with the united states congresswoman, Ms.B. Johnson, from Dallas, and any other representative that should uphold the legal rights of those who deem a rightful legal solution. I'm 64 Years Old , and unable to walk without the assistance of a cane, and yet I find myself in a most violent and cruel situation and conditions, enough is enough, 13 years of the same is not fair to anyone in the united states of America. Again, I thank you for your assistance and consideration in this most dreadful and dark conditions…

Further, my trial sentencing transcript reflects that it was the "legal intentions" of federal Judge Brown in Sherman, Texas, that I be confined at Three Rivers Federal Correctional Institution in Three Rivers, Texas. Instead, I was chained and shackled the next day and for the last 12 years, I was incarcerated at Leavenworth Federal Penitentiary. It has been extremely difficult to live with the fact and truth that my CONSTITUTIONAL RIGHTS under the United States Constitution of America have been purposely and maliciously violated by the Bureau of Prisons.
The violation of my Fifth Amendment, Due Process of the law (the bureau of Prisons and the United States Marshall's Office decided to disregard the legal Judicial intentions of Federal Judge Brown), the violation of my Eighth amendment, Cruel and unusual

The founding chapter of the American GI Forum hopes the appointment Saturday of four interim officers - including the commander and vice-commander - will help renew the organization that has seen a rocky year.
Officials with the Dr. Hector P. Garcia Founding Chapter of the American GI Forum appointed a commander, vice commander, secretary and treasurer to serve until September 2007, according to Cecilia Akers, Garcia's daughter and a lifetime member of the chapter.
Oscar Guerra will lead the chapter as commander, replacing Juventino Ortiz. Jose Espinoza was appointed vice commander; Cyruss Mallison as secretary; and Ron Garza as treasurer.
Each will serve until the founding chapter holds elections for new officers. New officers could not be elected because a quorum was not present at the meeting, which was approved by the national GI Forum and is one of the provisions that allowed the chapter to be reinstated this year.
Akers said state chapter officers would research the national constitution to ensure Mallison and Garza may serve if elected. Neither are veterans.
Ortiz, who said Friday the Saturday meeting was being held against some local members' wishes, called the appointments a fiasco.
"If the forum ceases to exist like it is now, we're looking at major problems," he said.
The chapter has faced numerous issues in recent months, including suspension and reinstatement in the national organization regarding financial documents the founding chapter did not hand over for an audit.
Part of the reinstatement agreement was to elect new officers, said C.P. Garcia, state commander of the American GI Forum.
Guerra said his duty is to help restore the organization.
"I know it's going to be hard to bring it up to standards, but God willing, we'll get there," said Guerra, an Air Force veteran who served in the Korean War.
Akers said the reorganization was designed to rebuild the chapter.
"We need to start following the agenda to help veterans and their families," Akers said. "We feel that the chapter can now move forward and get the negative publicity out of Corpus Christi."
