VA Benefits FAQs
1) What are the Eligibility Criteria for Veterans to Receive Benefits from the VA?

Eligibility for most VA benefits is based on discharge from active military service under other-than-dishonorable conditions. Active service means full-time service (and not active duty for training) as a member of the Marine Corps, Army, Navy, Air Force or Coast Guard or as a commissioned officer of the Public Health Service, Environmental Science Services Administration or National Oceanic and Atmospheric Administration, or its predecessor, the Coast and Geodetic Survey.

2) What kind of compensation are Veterans entitled to if they have a disability caused by Military Service?

When veterans are diagnosed with a disability that is "service-connected", the primary VA benefit they are entitled to is Disability Compensation. To apply for Disability Compensation, veterans must fill out a VA 21-526 form (Application for Disability Compensation and/or Pension) and file it with the Regional VA Office in their state. The "Regional Office" is a branch of the Federal Department of Veterans Affairs, not the State's Department of Veterans Affairs.

**Note: For veterans filing for an asbestos illness, there are some additional steps you need to take to justify your claim. You should use Part XIII – Remarks Section to detail your exposures to asbestos while on active duty. You should be specific and give examples of times you were exposed. Also include information about what you did before and after your military service. You will need to convince the VA that more than half of your lifetime exposure to asbestos occurred on active duty. If the remarks section is too small to provide all the detail you feel is necessary to explain your exposure, you can write it on a separate sheet of paper, and attach it to the 526 and simply refer to the attachment in the Remarks section of the application. (Example: For a continuation of Part XIII, write "Continuation of Part XIII" at the top of the page, and then include your name VA claim number. If this is your first claim, you will not have a VA claim number. Write your Social Security number instead.)

3) Are there benefits for Veterans based on income?

Although most benefits (such as disability compensation) are based on whether a veteran has a service-connected disability, it is possible to receive benefits (such as VA pension) and qualify for VA health services even if you do not have a service-connected disability. To qualify, you must show that your income and personal assets prevent you from enjoying a minimum quality of life or affording your own health care insurance. Veterans can only receive VA disability compensation or pension, but not both. If a veteran qualifies for both, he will be awarded the higher-paying monthly benefit (which is typically disability compensation). If a veteran qualifies for VA health services solely based on income, they are usually required to make co-pays for VA prescriptions and health-care services.

4) What information or evidence must I show to substantiate my Disability Claim?

To substantiate a claim for service connection, the evidence must show three things:

You have an injury or disease that began or was made worse during military service, or there was an event during service that caused injury or disease. In the case of asbestos illnesses, the event is the exposure to asbestos while on active duty. The VA will look at pre- and post-service asbestos exposure. To demonstrate the illness is "service-connected," the veteran must make that case that the active duty exposure was more likely than not, the cause of the disease.
You now have a physical or mental disability, as backed by medical records.
Your current disability is related to the injury, disease, or event in military service. Again, medical evidence may be needed. This means you must have medical evidence to demonstrate that you have an accepted "asbestos" disease.
5) What diseases are recognized by VA as being caused by asbestos?

The VA acknowledges that inhalation of asbestos fibers can produce:

fibrosis, the most commonly occurring of which is interstitial asbestos pulmonary fibrosis
asbestosis
tumors
pleural effusions and fibrosis
pleural plaques
mesothelioma of pleura and peritoneum
cancers of the
lung
bronchus
gastrointestinal tract
larynx
pharynx, and
urogenital system, except the prostate.
The biological actions of the various fibers differ in some respects, in that:

chrysotile products

have their initial effects on the small airways of the lung
cause asbestosis more slowly, and
result in lung cancer more often, and
crocidolite and amosite

have more initial effects on the small blood vessels of the lung, alveolar walls, and pleura, and result more often in mesothelioma.
Note: Generally speaking, a doctor must state in writing that an illness has been caused by asbestos. Exceptions are asbestosis and mesothelioma, which are accepted by the VA as ONLY caused by asbestos exposure.

6) What factors will the VA consider when deciding on my asbestos claim?

When deciding a claim for service connection for a disability related to exposure to asbestos, the VA will:

determine if service records demonstrate the veteran was exposed to asbestos during service
ensure that development is accomplished to determine if the veteran was exposed to asbestos either before or after service, and
determine if a relationship exists between exposure to asbestos and the claimed disease.
7) What is a Veterans Service Officer (VSO) and what does a VSO do?

VSO's are paid by either a state's Department of Veterans Affairs or by one of the many Veterans Service Organizations to act as a direct representative of the veteran when dealing with the VA. But VSOs do NOT work for the VA. VSO also assist veterans in filling out paperwork, ensuring it is complete and correct before filing, and will track the claim progress. We instruct veterans not to deal directly with the VA but to work through a VSO, who are experts in the process and can act as guides through a complicated process.

8) What does the VSO need to file my disability claim with the VA?

To apply for Disability Compensation, veterans need to provide their VSO the following items:

A completed VA 21-526.
A copy of their DD 214 (discharge paperwork). If this paperwork has disappeared, a copy can be in obtained from the National Personnel Records Center. A VSO can assist in this.
Copies of pertinent medical records (or a signed medical release allowing the VA to request those records).*
If the veteran is married, a copy of the marriage certificate (this proves he/she has a dependant which provides for greater disability compensation).
*This document is a VA-21-4142 and is included at the end of the VA 21-526 form.

9) How do I find a VSO?

If you have been diagnosed with an asbestos disease and need assistance in finding a nearby Veteran Service Officer, the easiest way is to contact our veterans department. A veteran counselor can assist you in locating a VSO. If you live in a rural area, a good option is asking your state or county about VSOs that work for them. VSOs that work for one of the Veteran Service Organizations – such as AMVETS or Disabled American Veterans – are typically located in large metropolitan areas.

10) What does the VA do after it receives my claim?

After the VA receives an Application for Disability Compensation, it sends a confirmation letter to the veteran outlining what was received. It will also schedule a medical appointment at the nearest VA Medical Facility so the veteran can be evaluated. During the exam, the veteran will be asked about asbestos exposure while on active duty and after active duty. For asbestos cancers, a medical exam is typically not required: Medical records diagnosing that cancer are often sufficient.

11) How much will I receive if I am approved for VA Disability Compensation?

Payments by the VA for a "service connected" disability are based on a rating given by the VA, expressed in 10% increments. Exact disability payments vary. They depend on:

the disability rating.
the number of dependents.
and other factors, such as whether the veteran is house-bound or in need of regular aid and attendance.
The basic payment varies between $123 a month for a veteran with a 10% disability rating to $2,673 a month for a 100% disability rating. Mesothelioma and Lung Cancers caused by asbestos are rated at 100%. Non-cancerous asbestos illnesses are rated anywhere from 0% to 100% (primarily based on the results of a Pulmonary Function Test).

12) How long will it take for the VA to make a decision on my claim?

It's different in every state.

The amount of time it takes to adjudicate a Disability Compensation claim varies depending on State.

The U.S. Department of Veterans Affairs has one or more VA Regional Offices in each state, and backlogs vary by state. Generally speaking, it takes about 6-8 months to get a decision. However, the VA's "Fully Developed Claim" (FDC) program now allows veterans or a counselor to gather necessary paperwork to help the VA's rating representative make a decision on a claim. The program has helped expedite claims through the VA's vast system, typically resulting in decisions in only a few months. If you have been diagnosed with an asbestos disease and would like more information about how to file using the FDC program, contact our veterans department and one of our veterans counselors will provide you with the information and assistance necessary to file a FDC.

13) What is Dependency and Indemnity Compensation (DIC) and who is eligible for it?

DIC is a benefit paid to a surviving spouse and/or dependent children of a veteran who died from a service-connected disability. For a survivor to be eligible for DIC, the veteran's death must have stemmed from one of the following:

A disease or injury incurred or aggravated in the line of duty while on active duty or active duty for training.
An injury incurred or aggravated in the line of duty while on inactive duty training.
A service-connected disability or a condition directly related to a service-connected disability.
Spouses receive a basic monthly payment, plus an additional payment for dependent children if they require aid and assistance, or if they are house-bound. For more information, contact your local VSO.

14) Will a lawsuit against an asbestos company affect my VA disability benefits?

No. The VA is not concerned about any money you may be awarded from a lawsuit or from an asbestos company's bankruptcy trust fund when applying for VA Disability Compensation. The VA's primary financial concern is that you do not "double-dip" on a benefit – that any disability payments you receive aren't also coming from the military for the same disability. You cannot receive money from the government twice for the same illness. The VA also will consider your financial situation when the benefit for which you are applying is based on your income level, such as a VA Pension.

INTRODUCTION

The veteran served on active duty from June 1974 to May 1978.

This case initially came before the Board of Veterans'
Appeals (Board) on appeal from the Pittsburgh, Pennsylvania,
Department of Veterans Affairs (VA) Regional Office (RO).

In October 2002, the Board remanded the claim for a
videoconference hearing, but the veteran withdrew his request
for a hearing in April 2005 correspondence. The Board again
remanded the claim for additional development in May 2005 and
August 2006. Substantial compliance having been completed
the case has been returned to the Board. Since the last
supplemental statement of the case, the veteran has submitted
additional evidence. In a December 2007 informal hearing
presentation, the veteran's representative waived the RO's
consideration of this new evidence. See 38 C.F.R.
§ 20.1304(c) (2007).

In July 2006, the Board granted the veteran's motion to
advance his case on the Board's docket. See 38 U.S.C.A. §
7107 (West 2002); 38 C.F.R. § 20.900(c) (2007).

FINDING OF FACT

Competent medical evidence of record supports a finding that
a pulmonary disorder is more likely than not the result of
asbestos exposure during the veteran's active military
service.

CONCLUSION OF LAW

With resolution of reasonable doubt in the veteran's favor,
an asbestos-related pulmonary disorder was incurred during
active military service. 38 U.S.C.A. §§ 1110, 1131, 5107
(West 2002 & Supp. 2007); 38 C.F.R. §§ 3.102, 3.303 (2007).
REASONS AND BASES FOR FINDING AND CONCLUSION
I. Duty to Notify and Assist

As provided for by the Veterans Claims Assistance Act of 2000
(VCAA), the United States Department of Veterans Affairs (VA)
has a duty to notify and assist claimants in substantiating a
claim for VA benefits. 38 U.S.C.A. §§ 5100, 5102, 5103,
5103A, 5107, 5126 (West 2002 & Supp. 2007); 38 C.F.R.
§§ 3.102, 3.156(a), 3.159 and 3.326(a) (2007). In this case,
the Board is granting in full the benefit sought on appeal.
Accordingly, assuming, without deciding, that any error was
committed with respect to either the duty to notify or the
duty to assist, such error was harmless and will not be
further discussed.

II. Service Connection

The veteran asserts that he has an asbestos-related pulmonary
disorder caused by exposure to asbestos exposure while
serving as a machinist's mate aboard ship while on active
duty in the United States Navy.

Service connection may be granted for a disability resulting
from disease or injury incurred in or aggravated by service.
38 U.S.C.A. §§ 1110, 1131; 38 C.F.R. § 3.303(a). Service
connection may also be granted for any disease diagnosed
after discharge when all of the evidence establishes that the
disease was incurred in service. 38 C.F.R. § 3.303(d).

To prevail on the issue of service connection, there must be
medical evidence of a current disability; medical evidence,
or in certain circumstances, lay evidence of in-service
occurrence or aggravation of a disease or injury; and medical
evidence of a nexus between an in-service injury or disease
and the current disability. See Hickson v. West, 12 Vet.
App. 247, 253 (1999).

The chronicity provision of 38 C.F.R. § 3.303(b) is
applicable where the evidence, regardless of its date, shows
that the veteran had a chronic condition in service or during
an applicable presumption period and still has such
condition. Such evidence must be medical unless it relates
to a condition as to which, under the Court's case law, lay
observation is competent. Savage v. Gober, 10 Vet. App. 488,
498 (1997). In addition, if a condition noted during service
is not shown to be chronic, then generally a showing of
continuity of symptomatology after service is required for
service connection. 38 C.F.R. § 3.303(b).

There is no specific statutory or regulatory guidance with
regard to claims for service connection for asbestosis or
other asbestos-related diseases. However, in 1988, VA issued
a circular on asbestos-related diseases that provided
guidelines for considering asbestos compensation claims. See
Department of Veterans Benefits, Veterans' Administration,
DVB Circular 21-88-8, Asbestos-Related Diseases (May 11,
1988). The information and instructions contained in the DVB
Circular have since been included in VA Adjudication
Procedure Manual, M21-1MR, Part IV, Subpart ii, Chapter 2,
Section C (hereinafter "M21-1MR"). Also, an opinion by
VA's Office of General Counsel discusses the development of
asbestos claims. See VAOPGCPREC 4- 2000 (April 13, 2000),
published at 65 Fed. Reg. 33422 (2000).

VA must analyze the veteran's claim of entitlement to service
connection for an asbestos-related pulmonary disorder under
these administrative protocols using the following criteria.
Ennis v. Brown, 4 Vet. App. 523, 527 (1993); McGinty v.
Brown, 4 Vet. App. 428, 432 (1993). The M21-1MR contains
guidelines for the development of asbestos exposure cases.
Paragraph (a) lists common materials that may contain
asbestos including steam pipes for heating units and boilers,
ceiling tiles, roofing shingles, wallboard, fire-proofing
materials, and thermal insulation.

Paragraph (b) in essence acknowledges that inhalation of
asbestos fibers can result in fibrosis, the most commonly
occurring of which is interstitial pulmonary fibrosis or
asbestosis. Inhaling asbestos fibers can also lead to
pleural effusions and fibrosis, pleural plaques,
mesotheliomas of the pleura and peritoneum, and cancer of the
lung, bronchus, gastrointestinal tract, larynx, pharynx, and
urogenital system (except the prostate).

Paragraph (d) notes that the latency period for development
of disease due to exposure to asbestos ranges from 10 to 45
or more years between the first exposure and the development
of the disease.

Paragraph (e) provides that a clinical diagnosis of
asbestosis requires a history of exposure and radiographic
evidence of parenchymal lung disease. Symptoms and signs
include dyspnea on exertion, end-respiratory rales over the
lower lobes, compensatory emphysema, clubbing of the fingers
at late stages, and pulmonary function impairment and cor
pulmonale that can be demonstrated by instrumental methods.

Paragraph (h) provides that VA must determine whether service
records demonstrate evidence of asbestos exposure during
service; whether there is pre-service and/or post-service
evidence of occupational or other asbestos exposure; and then
make a determination as to the relationship between asbestos
exposure and the claimed disease, keeping in mind the latency
and exposure information pertinent to the veteran.

When all the evidence is assembled, VA is responsible for
determining whether the evidence supports the claim or is in
relative equipoise, with the veteran prevailing in either
event, or whether a preponderance of the evidence is against
a claim, in which case, the claim is denied. Gilbert v.
Derwinski, 1 Vet. App. 49 (1990).

The veteran has submitted a great deal of evidence to support
his contention that he was exposed to asbestos while serving
in the Navy, including on line research, articles, training
manual excerpts, and "buddy" statements. The veteran's
service personnel records show that he was a machinist's mate
who was assigned to the engine room of the U.S.S. Neosho
during his service. Multiple letters written by fellow
sailors detail asbestos exposure by the veteran, and an
August 2005 letter from the contractor assigned with
dismantling the ship the veteran served aboard reported that
after the ship was 50 percent dismantled asbestos disposal
logs showed that 186.35 tons of asbestos had been removed.
This letter also notes that the ship had significant levels
of asbestos in certain areas, including the engine room. The
evidence of record shows that the veteran was exposed to a
significant amount of asbestos while in service.

A December 1999 CT (computed tomography) scan report prepared
by Dr. "G.S." of the Dubois Regional Medical Center was
interpreted to show the veteran with interstitial fibrotic
changes. A private physician, Dr. "A.I.," diagnosed the
veteran with mild restrictive lung disease (January 2000),
mild interstitial pulmonary fibrosis (August 2000), and
asbestosis (January 2001) based on this CT scan and pulmonary
function tests. Doctor "A.I." also indicated in his August
2000 letter that it was likely that the veteran developed
mild interstitial pulmonary fibrosis during service, possibly
related to asbestos exposure at that time. A VA examiner in
October 2000 diagnosed the veteran with mild interstitial
pulmonary fibrosis but could not state with certainty whether
the veteran had asbestos related disease. The VA examiner
and Dr. "A.I." both indicated that manifestations such as
pleural plaques would strengthen an association between
interstitial pulmonary fibrosis and exposure to asbestos, and
that a lung biopsy would provide the most definitive
diagnosis.

Further examination was requested to clarify the matter, and
in March 2006 a VA examiner concluded that the veteran had no
restrictive lung disease based on contemporaneous chest x-
rays and pulmonary function tests. The Board then remanded
the claim for another VA examiner to review the evidence and
identify the precise nature and etiology of any lung disorder
in light of all of the medical evidence, portions of which
were conflicting.

The veteran was afforded this VA examination in May 2007. A
pulmonary function test that day was reported as normal. In
explaining some of the conflicting evidence, the examiner
stated that a CT scan was more extensive than a chest x-ray
and that where there may not be any changes noted on a chest
x-ray they may still be evident on a CT scan. She also noted
that the most recent CT scan, from 2003, was negative. Given
that pulmonary function testing was normal dating back to
2003 and a CT scan dated from 2003 was reported as normal,
the examiner stated that she could not find any objective
evidence of any defined pulmonary disorder. She recommended
another CT scan.

After the examiner obtained a June 2007 CT scan and results
she added an addendum to the examination report which stated
that after review of the actual film with another physician,
she felt the veteran had very mild interstitial fibrosis in
both lungs. She noted that there was no evidence of pleural
plaques that would associate this fibrosis with the veteran's
asbestos exposure. Given that pulmonary function tests were
normal, she still felt it was more likely than not that the
veteran's current complaints were not related to interstitial
fibrosis or asbestos exposure incurred while in the military.
She stated that she could not totally rule out that
interstitial fibrosis may be associated with asbestos
exposure, and explained that she would suspect that if this
were the case there would be evidence of progression
reflected in decline of pulmonary function tests. Therefore,
it was her opinion that it is more likely than not that the
mild interstitial fibrosis is not related to asbestos
exposure incurred in the military.

Earlier in her report, the examiner explained that pleural
plaques help differentiate asbestos-induced parenchymal
disease from other interstitial lung disease. Pulmonary
fibrosis with an associated pleural plaque is more likely to
support asbestosis-related fibrotic disease from other
interstitial lung disease. She also relayed that an open
lung biopsy would be the most definitive diagnosis. As noted
above, the October 2000 VA examiner and Dr. "A.I." also
both indicated that pleural plaques would strengthen an
association between interstitial pulmonary fibrosis and
exposure to asbestos, and that a lung biopsy would provide
the most definitive diagnosis.

An open lung biopsy was performed by a private physician in
October 2007. According to the report associated with this
procedure, two pleural plaques were found.

The current competent medical evidence shows interstitial
pulmonary fibrosis confirmed by a June 2007 CT scan.
Different medical professionals have on multiple occasions
stated that the presence of pleural plaques would help
differentiate asbestos-induced parenchymal disease from other
interstitial lung disease. Pleural plaques were found during
an October 2007 lung biopsy, the procedure that multiple
physicians have stated would provide the most definitive
diagnosis. Considering the above, the Board is of the
opinion that the evidence is at least in equipoise as to
whether or not the veteran's interstitial pulmonary fibrosis
is related to his in-service asbestos exposure. Therefore,
resolving reasonable doubt in the veteran's favor, service
connection for an asbestos-related pulmonary disorder is
warranted. 38 U.S.C.A. § 5107(b); 38 C.F.R. § 3.102;
Gilbert, 1 Vet. App. 49.

ORDER

Entitlement to service connection for an asbestos-related
pulmonary disorder is granted.

A local attorney has announced he is running for chairman of the Nueces County Democratic Party.

There has been talk that several people might run. On Monday, attorney Robert Zamora officially announced that he has filed for the position, which is now held by Alex Garcia Jr.

"I have not only experience as a lawyer operating my own business for close to 30 years," Zamora said. "What I would like to do is lend the energy and the experience that I have to the operation of the Democratic Party here in Nueces County.

The race will be decided in the state presidential primary in March.

Try to ease the concerns, try to answer questions but most of all do not displace your frustration and try real hard to never lose your temper. Name calling is divisive and defeats your expression of reasoning regardless of strength or logic. Try to understand and consider the wisdom of the body who you represent. Forgiveness begins with an Apology.

Also, I would like to point out that Hispanics are only one of the unrepresented people who in unity make up "The American Warrior". If I understand correctly, this documentary is Historically unrepresentative and inaccurate in many aspects.

The point is not about a bias toward Hispanic Soldiers but an ignorance Mr Burns will not address. To ignore the complete portrait of the American Warrior and leave out very significant heroes and characters is not about race but about skewing history and a man who refused to do his homework.

Protesters packed the VFW Post on 10th Street, Thursday, September 13th in support of "Defend the Honor" San Antonio Coalition.

One after one, speakers complained that only 18 minutes of a 14-hour documentary produced by Ken Burns for PBS on WWII to air September 23rd, mentioned contributions of Hispanic soldiers to the War. One speaker pointed out that Hispanics contributed the highest number of Congressional Medal of Honor recipients among minority groups who served in that war.

For someone who proclaims his independence from the White House, U.S. Sen. John Cornyn of Texas can still sound like a cheerleader for President Bush.

Speaking to fellow Republicans in Fort Worth at a presidential straw poll recently, Cornyn staked a claim to re-election next year as a pro-war, anti-tax candidate who expects to match up with voter sentiments in his home state.

He stressed his support for the course Bush has set in Iraq and suggested that voters can rely only on Republicans to extend the tax cuts Bush made in his first term.

Two Democratic Senate hopefuls, San Antonio lawyer Mikal Watts and state Rep. Rick Noriega of Houston, are counting on voters to hold Cornyn accountable for Republican stewardship of Congress in the first four years of his six-year term.

"People will not rehire someone who has had bad plans replaced by more bad plans," Noriega said.

Watts called Cornyn a senator "who parrots exactly what he's told to say by this administration and Karl Rove," the former White House counselor.

Cornyn, who ran in 2002 as part of "Team Bush," said in an August interview that he has been a Bush ally on judicial appointments and the war on terrorism but that he has also parted with his friend on a few issues.

A Cornyn proposal to allow greater access to federal records has cleared the Senate without White House backing. Cornyn also is among senators at odds with the president by proposing to give states alternative ways of complying with the federal education accountability system that Bush started.

Also, he and Sen. Edward Kennedy, D-Mass., are seeking to grant the Food and Drug Administration regulatory authority over tobacco and ingredients including nicotine, a step yet to be endorsed by Bush.

This summer, Cornyn opposed the Bush-favored compromise on changes to immigration policy. The senator unsuccessfully offered an amendment barring felons and other offenders from legal residency.

He later called Bush tone-deaf on the issue. "I don't think he had any real concept of the public engagement on that issue," he said.

In Fort Worth, though, Cornyn said Bush was absolutely right to raise the specter of Vietnam when discussing Democrats' calls for a timed withdrawal of troops from Iraq.

If American forces leave prematurely, Cornyn said, the region will plunge into a humanitarian crisis, and unwatched terrorists will plot attacks. "Unless we get the job done, they will follow us here," he said. "And we've got to make sure that never ever happens again. Not another 9/11, not ever."

His Democratic opponents each noted that as young men, Cornyn and Bush didn't serve in Vietnam.

Noriega, a lieutenant colonel in the Texas National Guard, said, "Comparing Vietnam to the Middle East is like comparing apples to wheat; they are not in the same food group. Differences include geography, terrain, cultures, religion, technology, history of region, just to name a few. This is just another example of the unfortunate circumstance we face when we have leaders who have not walked the walk."

Watts said, "I don't think there is a plan for victory in Iraq. ... We have to stay in the region, but I don't think we should be standing around on street corners getting shot at while we observe someone else's civil war."

On the domestic front, Cornyn charged Democrats with planning not to extend tax cuts enacted at Bush's request starting in 2001. Barring congressional action, cuts of income, capital gains, dividends and other taxes will expire in 2011.

On Capitol Hill, the cuts are rated either Bush's keystone domestic achievement or a gift to the nation's wealthiest residents.

The nonpartisan Congressional Budget Office estimates that extending the tax cuts would cost the government more than $1.8 trillion through 2017.

Tax-cut advocates say such money rightly belongs to taxpayers.

Cornyn's take: Democrats will let into law the biggest tax increase in history.

"They're going to do it without a single vote unless we get the majority back," he said. "They're going to do it because the tax relief that we passed under President Bush back in 2003 will expire unless we make it permanent. And we have to get the majority back and keep taxes low and keep America growing."

Watts said he would review each tax cut one by one but opposes extending cuts for the wealthy as long as government runs a deficit.

Noriega called it "blatantly false" to forecast all the cuts vanishing.

Nationally, 52 percent of voters favored making the tax cuts permanent in a poll conducted this year by Moore Information, an Oregon-based research firm. Thirty-eight percent preferred to let the cuts expire, and 10 percent had no opinion.

Republicans and a plurality of independents supported making the cuts permanent. A majority of Democrats wished to see them expire.

About half of respondents agreed that the cuts should be extended only for households with annual incomes of less than $150,000. About a third of voters favored making the cuts permanent for everyone.

Jason Furman, an economist and senior fellow with the Brookings Institution, an independent research outfit, testified before the House Ways and Means Committee last week that extending the cuts would widen after-tax income gaps between Americans.

Furman said a best-case U.S. Treasury projection suggests an extremely slight impact on the economy, with extended cuts more likely increasing the national debt and reducing government savings.

An eventual need to repay the cuts, he said, would drive down disposable income as taxpayers see cuts in government programs or bumps in taxes to bankroll the cuts, leaving at least three in four households with lower after-tax incomes.

"There is no free lunch because, ultimately, the government faces a budget constraint," Furman said.

Just got back from hooking some Big Reds at the Mother Lagoon. Now, that's WATT I'm talkin bout invoking a FIGHT. I had not had an opportunity to read the Caller Times and Jamie Powell's Political Pulse and one of the guys came up and starting telling us how Junior John attacked the internet community and Mikal WATTSFORSENATE Campaign amateur. He said, "They are talking about you all over the Newspaper today". I asked him, "What do you mean? Who is "they"?

He said that Senator guy Cornyn, he is saying that the blogs and the internet message are an amateur way for WATTS to Campaign. He is saying Mikal Watts but he is talking about you.

Well, I am not with the WATTSFORSENATE Campaign but I am going against Junior John.

The said to me, you must be starting to irritate them, getting to them with things they cannot defend or else he wouldn't say anything.

I told him, "I am a fly, and I am going a Junior John, I am now in his ear, He will scratch and scratch at his ear trying to get me out, he will scratch until he is bleeding, he will himself to death trying to get me out of his ear."

Rothenberg Report, calling Watts' campaign Web site video, "the silliest, most transparent attempt to deliver a message I have ever seen."

Who is Rothenberg and why should we care WATT he says? It is enough to know he is trying to get Junior John re-elected. His writing is meaningless rhetoric. Transparent? Transparency is a good thing, but obviously transparency is a negative attribute of Government according to the GOP?

We (Los Kenedenos) were going after Junior John prior to any Watts intentions to challenge the Junior Senator. Besides, why would a GOP Spokesman advise us? We are definitely in a good medium current or else ole Hans would not be advising us to "use another medium". We are definitely connecting with the "sweet spot" and they keep on changing pitchers. As far as fight, come and get it BOYS. Amateur, we take that as a compliment and it is a true statement, in our case.

WATT are you scared of Junior John?

Bring it now and may we dance everyday until the day when Texas will make their choice.

The Texas Republican Party went on the offensive Friday against lawyer Mikal Watts, who is making a run at Republican U.S. Sen. John Cornyn.

I was a candidate for the Del Mar Board of Regents. I picked up the package to run for office. I am College Educated. I have several degrees. I'm pretty good at reading and writing contracts and such. I'm not a lawyer and believe me I could have used a lawyer to explain all the stuff I was responsible for and had to do. Del Mar wasn't going to explain it to me and the local party bosses wouldn’t have anything to do with me. Del Mar certainly wasn't going to help Linda whose brother they had railroaded out of a job. Now Linda was the first person in a Corpus Christi Public Housing development to successfully run for a public office and her neighbors were very proud of her. So here we have a person who picked herself up by her bootstraps with out the aid of the local democratic or republican bosses and won her election. So what do the local politicos do and that includes our slimy DA

WASHINGTON (AP) — The House on Wednesday approved a move by conservative Republicans to try to set free two Border Patrol agents convicted of shooting a Mexican drug dealer.

After a long, emotional debate, the House voted by voice to block the Bureau of Prisons from keeping former agents Ignacio Ramos and Alonso Compean in federal prison. Ramos and Compean are serving 11- and 12-year federal prison sentences, respectively, for the 2005 shooting of Osvaldo Aldrete Davila on the Texas border near El Paso.

Ramos is serving time at Yazoo City Federal Correctional Complex about 40 miles northeast of Jackson, Miss. He was severely beaten by other inmates at the prison in February.

The case has caused a furor among conservative lawmakers and on talk radio across the country.

WASHINGTON -- Conservative Republican senators and a handful of Democrats are trying to put a final knife in President Bush's plan for legalizing millions of unlawful immigrants.

A broad immigration bill, embracing what critics call amnesty, survived a series of unfriendly amendments Wednesday.

Supporters must gain 60 votes in the 100-member chamber to limit debate and clear the way for a roll call on final passage, perhaps by Friday. Anything less will likely doom the legislation until a new president and Congress take office in 2009.

Junior John voted against the immigration measure that could grant legalization to the estimated 12 million unlawful immigrants if they pass background checks and pay fines and fees. It also would toughen border security and institute a new system for weeding out illegal immigrants from workplaces.

Sen. Bob Menendez, D-N.J., was among those disappointed Wednesday. The Senate voted 55-40 to reject his amendment that would have made it easier for some immigrants to obtain visas for family members left behind in their home countries.

TEXAS TIMES: A quiet hero remembered
by U.S. Sen. John Cornyn

The civil rights movement of the past 60 years has benefited from the involvement of many Texans, but one man stands out. His generosity and sense of equality have left a mark on this nation, which will always be felt.

Dr. Hector P. Garcia was a man of great moral clarity. When he saw injustice or human suffering, he acted. For that, he was occasionally reviled, and often honored. His life of service is an inspiration.

Hector Garcia was brought to Mercedes, Texas as a small child by parents fleeing the Mexican Revolution in 1917. He proved to be an able student, graduating from the University of Texas Medical School in 1940. He later joined the U.S. Army, serving as an infantryman, a combat engineer and a medical doctor during World War II. His distinguished service earned him the Bronze Star medal with six battle stars in Italy.

The U.S. military had always taken care to reward performance and merit, but when Garcia returned to Corpus Christi and began working with the Veterans Administration, he noticed a disturbing trend. To his disappointment, he found Mexican-American veterans were not receiving proper medical treatment and educational benefits.

“I had to learn the Constitution to become a citizen,” Garcia said. “I knew all the rights, all the things that it gave us.” In 1948, he founded the American GI Forum to push for equal treatment. A year later, the GI Forum and Garcia were catapulted into national prominence by what became known as the “Felix Longoria Affair.”

Felix Longoria, from Three Rivers, Texas, was a soldier killed by a Japanese sniper in the Philippines during World War II. He was originally interred there, but in 1949, his widow decided to move his body home.

The funeral director, however, declared she could not hold a wake in the town’s sole funeral chapel because the dead man was a Mexican-American.

Garcia contacted Texas’s junior U.S. Sen. Lyndon Johnson, who arranged a burial for Longoria with full military honors at Arlington National Cemetery, with Garcia and the news media in attendance.

Afterwards, the GI Forum became a forceful advocate and publicist for equal rights, and Garcia became highly controversial. Frank Perales, who now heads the GI Forum chapter in San Antonio, recalls Garcia throwing a blanket over himself in the back seat of a car to elude pursuers.

But Garcia did most of his best work quietly. Judge James deAnda recalled accompanying the doctor to an abandoned railroad boxcar to treat a dying grandfather.

“He took care of the man, and we would go in other homes that were just about as humble,” deAnda said. “The people obviously had no means of paying or even getting to his office. He would see all these people and administer to them. They had just absolute faith in the man.”

At one point, Garcia overturned an attempt by his accountant to file collection notices against some patients. “If these people could pay me, they would pay me,” he told him. “And you writing them a letter is not going to give them any money.”

At President Johnson’s nomination, Garcia became the first Mexican-American to serve as an ambassador to the United Nations. He was also the first Hispanic on the U.S. Commission on Civil Rights. Before he died in 1996, Garcia received dozens of additional awards and honors.

In 1984, President Ronald Reagan bestowed upon Garcia the Presidential Medal of Freedom. “That was the highlight of his life,” recalled Garcia’s daughter, Cecilia Akers. “He wore that medal everywhere he went.”

Earlier this year, Congress renewed the historic Voting Rights Act, and I received unanimous consent from my colleagues to add two Texas civil rights pioneers, including Garcia, to the official title. We’ll present an engraved copy of the bill to Garcia’s widow, Wanda, in San Antonio later this year.

Garcia’s story reminds us all that progress in our society is often made possible by the devotion of selfless men and women, who give and sacrifice for greater principles. We all benefit from Hector Garcia’s legacy, and it is a privilege to bestow this much-deserved honor upon him.

republic of texas: According to the Sentence Ramsey is to be Confined in Texas

Former Raza Unida gubernatorial candidate Ramsey Muñiz has been transferred from a federal corrections institute in Three Rivers six months after arriving at the facility.

Muñiz, who ran for governor of Texas in 1974 and 1975 under the Raza Unida Party, was transferred from Three Rivers on Tuesday.

Mike Truman, spokesman for the Federal Bureau of Prisons, said Muñiz is being housed in the Federal Transfer Facility in Oklahoma City until he can be transferred to another facility.

Truman said he could not release where Muñiz would be transferred or when, citing security concerns. He also said he did not know why Muñiz was transferred.

Muñiz, 64, is serving a life sentence for three felony drug convictions.

The Three Rivers Federal Correctional Institute, 77 miles northwest of Corpus Christi, has been the closest the former Miller High School football star and local defense attorney has been to home since his 1994 conviction.

Under the banner of Raza Unida, a political party shaped and led by Hispanic activists seeking a political voice, Muñiz earned support from 6 percent the state's registered voters.

Muñiz's wife, Irma Muñiz, said she was surprised to learn of the transfer especially because senators, congressmen and civic groups have written letters to the Federal Bureau of Prisons on her husband's behalf.

Irma Muñiz said her husband had hoped to be housed at the Three Rivers facility because of its proximity to his family in South Texas.

Since he was transferred there in December from an institute in Colorado, Irma Muñiz has made frequent trips to visit her husband.

She likened Muñiz's transfer out of Three Rivers to the treatment of Hispanic Civil Rights figure Felix Longoria.

Longoria, a U.S. Army private killed on-duty in the Philippines in 1945, was refused a proper funeral in his hometown of Three Rivers because the only funeral home in town didn't allow Hispanics to use its funeral chapel.

Civil Rights hero Dr. Hector P. Garcia interceded and U.S. Sen. Lyndon Johnson arranged for Longoria to be buried in Arlington National Cemetery.

Joe Ortiz, League of United Latin American Citizens district director and national and state civil rights director of the American GI Forum, helped organize letter-writing campaigns when Muñiz was in Colorado asking for his transfer to Texas.

Ortiz didn't know about the transfer out of Three Rivers but said both LULAC and the American GI Forum will work toward getting Muñiz returned to Texas.

"We are going to petition our legislators to see if they can do anything to bring him back," Ortiz said.

I am certain that Ramsey Muniz was falsely imprisoned, but no matter what you believe, he was and is a model prisoner, and it is a complete waste of taxpayer money to be moving him all over, when it makes the most sense for him to be here near his family. He didn't kill anybody, and his treatment has been nothing but inhumane. Something has to be done about the inequities in our prison system. His punishment certainly does not fit his supposed crime. When is his mistreatment and that of his family going to end?

As a career Federal Agent living in Detroit, Michigan, I find it silly to deny this man the opportunity of being close to his family. As one person stated earlier that far worse criminals are given the option to be close to their family. Also, The whole war on drugs is nothing more than a farce to make contractors rich.

Maybe not in our lifetimes but down the road there will be Spanish spoken along with English in the schools, businesses and professional sports, to name a few, all across America not just Texas. Earlier this month, Vincent Saldano, one of the 468 inmates on Texas' death row, had his death sentence vacated. This development was duly reported in the press. But accounts of Saldano's good fortune uniformly failed to appreciate what makes his reprieve truly newsworthy and potentially a landmark.

Saving Saldano: Texas Confesses Error

Saldano was not freed from the prospect of execution by the actions of a court or even, as occasionally happens, by the clemency of a governor. His death sentence was erased because Texas, through its newly created office of the solicitor general, "confessed error" in his case -- that is, it admitted, despite defeating Saldano's initial appeals in court, that his death sentence was illegally obtained. Quite simply, this never happens, either in Texas or in the dozens of other states with active death penalty laws. It is thus worth pausing to consider the value and potential implications of Saldano's case as well as the notion of confessing error.

Saldano had received a death sentence in part due to profoundly troubling testimony by a state expert witness at the sentencing phase of his trial. The expert, a clinical psychologist named Walter Quijano, suggested that Saldano should be executed because, as an Hispanic, he posed a special risk of future dangerousness to society. To support this astonishing conclusion, the expert pointed out that Hispanics make up a disproportionately large amount of Texas' prison population.

It does not take a tenured professor of constitutional law to realize that linking racial identity with a propensity for violence was not only bizarre but also a violation of the equal protection clause. Indeed, that it should take a confession of error by the state to correct this problem highlights at least two problems in the current administration of the death penalty. First, in seeking the death penalty, prosecutors sometimes overlook glaring illegalities. The same flaw identified in Saldano's case infects at least seven other Texas capital cases. Second (and perhaps even more distressing), courts, especially state courts, are too often willing to overlook even obvious constitutional flaws when reviewing death penalty cases. After all, before the state's confession of error, Saldano had lost all of his appeals.

Under these circumstances, one might think that confessions of error would be, if not commonplace, at least occasional. On average, the Solicitor General of the United States confesses error in two or three criminal cases every year -- even though it is a safe bet that federal prosecutions, conducted by better trained lawyers with greater supervision, are less likely to contain obvious legal errors than their state counterparts. As the Supreme Court recognized when endorsing the practice in 1942, "the public trust reposed in the law enforcement officers of the Government requires that they be quick to confess error, when, in their opinion, a miscarriage of justice may result from their remaining silent." But as a practical matter, states never confess error in death penalty cases (even though courts overturn roughly two-thirds of all death sentences as legally infirm) -- and some states candidly admit that their policy is never to confess error.

Mutual Distrust

Why? One crucial and usually overlooked factor is the deep antagonism that has grown up over time between state death penalty prosecutors and the death penalty abolitionist lawyers who seek to foil them in every case. The abolitionists, prosecutors know all too well, never concede that their clients deserve the death penalty or that the death penalty was legally imposed -- no matter how flimsy their arguments in a given case. Rather, they use every procedural and substantive trick in the book to delay executions.

There can be no denying that such abolitionist tactics have angered and frustrated state prosecutors. And one response to these understandable emotions has been for prosecutors to mirror the fight-to-the-bitter-end approach of their opponents.

The problem with this reciprocation, however, is simply that the ethical duties of prosecutors and defense attorneys are vastly different. Defense attorneys are duty-bound to scratch and claw to win for their clients. Prosecutors, by contrast, despite striking hard blows, must never lose sight of their ultimate obligation to do justice in every case.

That may sound trite and perhaps overly idealistic, but it has a practical side as well. Prosecutorial confessions of error -- knowing when to fold them, as it is known -- establish credibility. They create trust in the system, a sense that someone is being careful and exercising sound judgment, that extends far beyond any single case. And that can make a world of difference for someone like me, who is not morally opposed to the death penalty but skeptical of how it is imposed.

Death Penalty Politics

In addition, the reluctance of state prosecutors to confess error is a clear reflection of how politics affects the death penalty. Up until now, anyway, undoing a death sentence was akin to political suicide for an elected district attorney or state attorney general, or for any state official with ambitions for re-election or higher office. And yet the willingness of Texas' new solicitor general to confess error in the Saldano case suggests a possible turning point. With the current groundswell of death penalty opposition based on the possibility of executing an innocent person, elected officials may now find some advantage in approaching capital cases (even those where innocence is not an issue) with a greater degree of care and honesty.

case will start a broad trend. But there is reason to believe that the tide is indeed turning. On June 9, Texas Attorney General John Cornyn announced the results of an investigation into other death penalty cases involving testimony by state expert Walter Quijano. Cornyn acknowledged that Dr. Quijano had provided testimony in six other death penalty cases similar to his improper testimony in the Saldano case. Cornyn's staff has advised defense lawyers for the six inmates now on death row that his office will not oppose efforts to overturn their sentences based on Quijano's testimony. In response, a pessimist might note that Texas is appealing a ruling in another capital case that the defendant received inadequate counsel -- when, indisputably, his lawyer slept through much of the trial. But doing the right thing has a contagious quality to it. Or at least so we can hope.

Give it a title, write a grant and set up a front office with a computer and a sign; then get some brochures and a few token clients and funnel the Avarice in a shell game like manner and voila a new ranch or a new house maybe an agency hummer or King Ranch Pickup Truck with a magnetic sign. CCISD: Why are CCISD Students allowed to run at large during school day hours?

Education is for our Children, our Youth, our Future. Children and Youth need constant redirection and set boundaries at home and at school as well. When a minor is allowed to run at large during the school day hours whether it is in the halls, leaving or returning a closed campus or simply unaccounted for is irresponsible of the caretaker whose custody in which he / she is placed.

An absent student is one who does not arrive at school in the morning and is absent for the WHOLE Day. The student was never on campus. The Parent is responsible for the student getting to school (requiring the student to attend school). If the student does not get to school it is the Parent’s responsibility not necessarily the Parent’s fault. There are circumstances where the student will walk in the front door and out the back door without attending a single class. This is where the attendance officers need to improve their due diligence like the old days.
Once the student is counted present in the morning; the Parent has required the student (child) to attend school. Once the student is verified in attendance at the beginning of the school day the student is in the custody of the School.
If the student is tardy or skips class (on campus or off campus) this happens on the watch of the school. The Parent if informed should cooperate and communicate with the School Counselors Administrators and the Attendance Officer to correct the behavior. The Security and Attendance officer should take notice and tighten the belt. This is a security issue as well; there is no excuse for students coming and going outside of the lunch period and it is imperative that attendance irregularities be dealt with within 24 hours. This is easily done with our modern technology.
Instead, what we are seeing is the Attendance Officers documenting the absences as they accumulate and filing on the Parent and student when the number of absences are achieved.

After analyzing the recent events surrounding the resignation of CCISD Board Trustee Harry Williams (1 of 3 at large district positions); one thing IS clear. That one thing is Due Process (or lack of it). Immediately one's memory of search firm fiascos and the CCISD Board tool of choice, the Interim Superintendent buffer / scapegoat. The process was elaborate and ethical reasons or rule were claimed as the reason for the process.

Well, why such a rush fellas?

Why is the CCISD board in such a hurry to fill this position?

A Superintendent position and a Trustee position; one we wine, dine and lodge and the other we announce for applications for a month or so and "narrow the list down" from 20 to 5 in most expedient fashion. Now, making a long story short we have 20 candidates who invested their creative, intellectual and professional abilities into a work product they hope will be scrutinized by the Board and be successfully competitive. A good letter of interest comes only from the heart. The application is at times tedious but at least it is more objective than the TAKS. Updating one's resume and with a list of references most meaningful to the position and all of this for 15 to get thrown in the trash can and the 5 resumes remaining are to place on public display

It is with great concern we bring this matter to your attention. The American GI Forum Dr. Hector P Garcia Founding Chapter remains divided. Is there a letter (from the AGIF State Leadership) stating, that Mr. Bob Ortiz is the rightful commander of the Founding Chapter? Citing this letter, Mr. Ortiz is removing chapter members from committees they were appointed to serve on. . In July 2006 the founding chapter underwent various sanctions for non-compliance with AGIF directives and remains in dispute with regard to financial records.

Last July, a GI Forum panel found former founding chapter commander Ram Chavez guilty of misconduct and expelled him from the national organization.

Despite the expulsion, the founding chapter re-elected him in August.

The charges against Chavez stemmed from a 2002 complaint in which a former member of the chapter stated he was expelled after he requested financial records from Chavez.

The documents included information about $50,000 paid to the chapter after a 1999 lawsuit filed by Dr. Xico Garcia, brother of civil rights activist and GI Forum founder Dr. Hector P. Garcia.

Vallecillo said the national board shifted the burden of producing the documents to the founding chapter's members.

Hector P. Garcia Chapter Vice Commander Bob Ortiz said the chapter is conducting an internal audit of bank records to assess the group's financial history.

According to a letter sent from the national organization to Ortiz, a chapter is required to turn in all financial records requested for IRS reporting purposes. CCCT

In late July 2006 the Chapter entered into an agreement with the AGIF state leadership.

After nearly a two-week suspension, the charter of the local chapter of the American GI Forum was restored Saturday evening.

"For the good and the welfare of this organization, we have entered into an agreement with the state of Texas leadership and the suspension has been lifted," said Tony Morales, national commander for the GI Forum and chairman of the organization board. CCCT

In the agreement financial records were to be turned over to the national office for tax purposes.

Requested documents include information about $50,000 paid to the chapter after a 1999 lawsuit filed by Dr. Xico Garcia, Dr. Hector P. Garcia's brother.

Cecilia Garcia Akers, Dr. Hector P. Garcia's daughter and a lifetime member of the founding chapter, said the financial documentation will be handed over to complete an IRS audit. CCCT

The finances of the local founding GI Forum chapter, with which the foundation is affiliated, were also a point of contention in late July, when the national organization suspended the chapter's charter for nearly two weeks for failing to turn over financial documents. CCCT

State Representative Juan Garcia has requested the Attorney General's intervention / investigation into this matter regarding Ram Chavez and those in the founding chapter loyal to Mr. Chavez.

WHEREAS, The American GI Forum, one of the country's leading

civil rights organizations, was founded by Mexican American

veterans in the aftermath of World War II; and

WHEREAS, Mexican Americans have long served with valor in the

armed forces of this country, compiling an exceptional record of

heroism; in the Second World War alone, 12 Mexican Americans, 9 of

them from Texas, earned the Medal of Honor, becoming the nation's

most decorated minority group in that conflict; on returning home,

however, many Latino veterans found themselves denied benefits that

they had earned under the G.I. Bill of Rights; and

WHEREAS, To redress that injustice, 700 Hispanic veterans,

led by Dr. Hector P. Garcia, founded the American GI Forum in Corpus

Christi on March 26, 1948; successful in its efforts to achieve

equitable treatment from the Veterans Administration, the forum

turned its attention to other veterans' concerns, such as

inadequate hospital care and the lack of Mexican American

representation on draft boards; and

WHEREAS, The forum demonstrated its effectiveness decisively

in 1949, when it intervened to help the family of Private Felix

Longoria, a soldier who had been killed on a volunteer mission in

the Philippines during World War II; when Private Longoria's body

was finally recovered and returned to his home in Three Rivers,

Texas, the local funeral home refused his family permission to use

its chapel for a service; after the forum sought assistance from

members of the Texas congressional delegation, Senator Lyndon

Johnson arranged for the soldier's burial in Arlington National

Cemetery; and

WHEREAS, In the 1950s, the forum began to use the legal system

to combat segregation and other discriminatory practices; forum

lawyers helped to secure a landmark ruling from the U.S. Supreme

Court in Hernandez v. the State of Texas, in 1954, a decision

finding that Mexican Americans were discriminated against as a

class and that they were entitled to protection under the 14th

Amendment; the forum also fought to end separate schooling for

Mexican American children, a practice ruled unlawful in 1957; and

WHEREAS, During that same decade, the forum conducted voter

registration drives, confronted incidents of police brutality,

addressed the problems of migrant workers, and sponsored student

scholarships; and

WHEREAS, The group took the name American GI Forum of Texas on

September 29, 1954, and became a national organization in 1958; Dr.

Clotilde Garcia, Dr. Hector Garcia's sister, founded a women's

auxiliary in 1956, and junior GI forums were also launched in some

areas; and

WHEREAS, Today, the forum embraces more than 500 chapters

across the nation and in Puerto Rico; it continues to support

returning veterans and their communities through such endeavors as

the Veterans Outreach Program, which provides training,

employment, and counseling for veterans in the Southwest, and

Ser-Jobs for Progress (SER), whose affiliates operate employment

training centers and residential and other services in Puerto Rico

and the continental U.S.; and

WHEREAS, For more than half a century, the American GI Forum

has played a vital role in our national life, advancing the cause of

social justice and touching the lives of countless Americans, and

it is indeed deserving of commendation for its exemplary efforts in

furthering the highest ideals of this nation; now, therefore, be it

RESOLVED, That the House of Representatives of the 80th Texas

Legislature hereby honor the American GI Forum on the 59th

anniversary of its founding and extend to all those associated with

this organization sincere appreciation for their outstanding

service; and, be it further

RESOLVED, That an official copy of this resolution be

relating to creating a recognition day in honor of Dr. Hector P.

Garcia.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Subchapter C, Chapter 662, Government Code, is

amended by adding Section 662.053 to read as follows:

Sec. 662.053. DR. HECTOR P. GARCIA DAY. (a) The third

Wednesday of September is Dr. Hector P. Garcia Day in memory of the

significant contributions to the Mexican American civil rights

movement of Dr. Hector P. Garcia.

(b) Dr. Hector P. Garcia Day shall be regularly observed by

appropriate ceremonies and activities in the public schools and

other places to properly commemorate the importance of the

contributions made by Dr. Garcia.

SECTION 2. This Act takes effect September 1, 2007.

WASHINGTON -- Hispanic groups unhappy with an upcoming Ken Burns documentary on World War II are stepping up pressure on PBS because the series omits mention of the role Latinos played in the war.

The latest group to take their grievance to PBS is the American GI Forum, a Hispanic veterans group that has waged numerous civil rights battles for Hispanics and Hispanic veterans.The American GI Forum is appealing to Hispanic veterans and other Latino groups to write members of Congress and their local PBS affiliates about the documentary, "The War," which has been six years in the making.This week, GI Forum President Antonio Morales of Fort Worth and other Latino leaders met in Washington with PBS President Paula Kerger to lodge their complaints about the 14-hour Burns documentary set to air this September, Hispanic Heritage month."We are not going to tolerate this omission," Morales said after the PBS meeting.PBS said it would respond in two weeks. In the meantime, the publicly funded network issued a statement that said:"While PBS has been a leading forum for these voices to be heard, there is more that needs to be done. We will expand upon our commitment, particularly around the creation and delivery of content that better represents the diversity of the audiences we serve."In a statement issued by his publicist, Burns and co-producer Lynn Novick said they were "dismayed and saddened" by any assumptions they intentionally left out any group. "Nothing could be further from the truth," they said.They urged viewers to see the series before judging it, and hope it will prompt discussions of World War II.The Burns series documents the war from the perspective of four U.S. communities: Waterbury, Conn.; Luverne, Minn.; Mobile, Ala.; and Sacramento, Calif."In this latest project, we have attempted to show the universal human experience of war by focusing on the testimonies of just a handful of people mostly from four American towns. As a result, millions of stories are not explored in our film," Burns and Novick said.The GI Forum also met with Hispanic members of Congress this week to plan a strategy to raise the issue nationally.The GI Forum was founded in 1948 in Corpus Christi, Texas, by a physician who recognized that Mexican-American veterans were not getting equal treatment in veterans hospitals or receiving benefits they were promised for their service.Their meeting followed one earlier this week by the Congressional Hispanic Caucus with Kerger and earlier meetings with PBS officials and a coalition of Hispanic groups that first took up the issue. The coalition is calling its fight the Defend the Honor campaign.The controversy over the Burns documentary has been simmering for months, since University of Texas journalism associate professor Maggie Rivas-Rodriguez learned the film did not include Hispanics.Rivas-Rodriguez has been compiling the oral histories of Latino World War II veterans over the past eight years with the help of volunteers and a small staff. National LULAC issues "gag order" on local LULAC Council #1

Subject: Border Patrol Issue

Dear Board Members,

Today our National Board met via a conference call regarding the resolution which was passed at our State Board meeting this past weekend. The resolution referenced our position regarding two Border Patrol Officers. As you recall, we do not endorse thier actions but mainly question the serverity of the punishment and asked for a pardon.

After much discussion it was voted by the National Board to enforce a "gag order" on all members of the organization, not only our Texas LULAC members, regarding speaking to the media on this issue. If a member of the media calls you please refer them to the National Office.

Please do not feel that our efforts were in vain because part of the end result is now that the National Office is going to move on looking into this type of sentencing with our Legislators in Washington. The smallest victory in the midst of a defeat, no matter how small, is still a victory. Hold you heads up high as proud Texas LULAC members and know that we did the right thing.

Please make sure that all of the councils in your district abide by our National Board's decision and let us now move on to other issues that effect Texas.

Joe A Ortiz response in Advocating for Ramsey Muniz: "To me, it was a no brainer"

Update to the past articles on the plight of Ramsey Muniz

Supporters of the former Corpus Christi resident said the punishment doesn't fit his crime. And in his first interview, since he was transferred to a prison in Three Rivers prison, he talked about his fight for freedom.

After more than a decade in what he considers "exile," Muniz is a Coastal Bend resident once again.

"I'm just real pleased, and I'm real happy to be back," he said.

The people responsible for keeping Ramsey in Prison are the ones who see him as a threat to their powerbase so for Joe A Ortiz, it was a no brainer .

Ironically, it was two semi-political groups that helped to bring him back. In 2006, the National organizations of LULAC and the American GI Forum both passed resolutions asking for his humanitarian release.

"To me, it was a no brainer, bringing this up," LULAC District Director Joe Ortiz said. "It just needed to be brought up. If it's not an Hispanic civil rights organization backing up Ramsey, then who will?"

Ramsey says he stays informed of Current Events, he says

"I get the USA Today; I get the Newsweek," he said. "I get Time; I get the Texas Monthly. I get every possible thing that I can stay up with."
